Michigan Has New Law Banning Hand Held Phones While Driving

What Are The New Laws?

Distracted driving has become a pressing concern in recent years, with cell phone use being a significant contributor to accidents on the road. In a significant stride towards safer roads, Michigan has recently enacted a new law that prohibits the use of handheld cell phones while driving. This legislation, aimed at curbing distracted driving. Let's dive into the details of this law and understand its impact on road safety.
Previously, Michigan’s distracted driving law banned texting while driving. The new law expands the distracted driving law to ban most handheld cell phone use while driving. Under the new law, it is now illegal for drivers in Michigan to use handheld cell phones while operating a vehicle. 
Starting June 30, 2023, Michigan drivers can be pulled over and ticketed if seen using their hands to: 
  • Send or receive a telephone call.
  • Send, receive, or read a text message.
  • View, record, or transmit a video.
  • Access, read, or post to a social networking site. 

ARE THERE ANY EXCEPTIONS? 

Exceptions are made for emergency situations where contacting emergency services is necessary.

CAN YOU USE YOUR PHONE HANDS-FREE?

 Yes, there is a hands-free exception to the new law. This allows drivers to use their phones and/or mobile device as long as they are using it hands free/voice operated, or if it is placed in a mount.

WHAT ARE THE PENALTIES FOR VIOLATORS? 

Michigan's new law comes with penalties for those who violate it. The implementation of strict penalties serves as a deterrent, encouraging drivers to comply with the law and prioritize safe driving practices. The penalties for violation of Michigan’s distracted driving laws may include: 
(1)  First violation - a fine of $100 and/or 16 hours of community service
(2)  Second violation – a fine of $250 and/or 24 hours of community service
(3)  Three or more violations within 3-year period – driver’s improvement course 
The ban on handheld phones while driving is expected to have a positive impact on road safety in Michigan. By removing the temptation and distractions associated with phone usage, the law seeks to improve driver focus, reaction times, and overall awareness.
